Divorce Lawyer in Faridabad

Faridabad is one of Haryana’s largest cities and sits directly south of Delhi. Divorce cases filed here are heard by the Haryana courts, with appeals to the Punjab and Haryana High Court. Because many Faridabad families have close ties to South Delhi, and because Palwal is now a separate district, choosing the right court is an important first step. Family courts in Faridabad

Faridabad district’s courts sit at the district court complex in Sector 12, Faridabad. The Family Courts there hear divorce petitions under the Hindu Marriage Act and the Special Marriage Act, as well as maintenance, custody and guardianship matters, for areas including Old Faridabad, NIT, Ballabgarh, Greater Faridabad and the sectors along the Mathura Road corridor.

Appeals from the Faridabad Family Courts go to the Punjab and Haryana High Court at Chandigarh, which is also the forum for petitions to quash related criminal cases after a settlement. Couples coming from Delhi should note that this is a different High Court from the Delhi High Court.

Faridabad, Palwal or South Delhi?

Three situations come up often for Faridabad residents:

  • Palwal. Palwal was carved out of Faridabad as a separate district in 2008 and has its own courts. A spouse living in Palwal, or a couple who last lived together there, may need to file in Palwal rather than Faridabad.
  • South Delhi. Many Faridabad families married in South Delhi or lived there earlier. If the marriage was solemnised in Delhi, or the couple last lived together there, the Family Courts at Saket may also have jurisdiction.
  • Wife’s residence. Where the wife is the petitioner, she may file where she currently lives, which can be Faridabad even if the marriage and matrimonial home were elsewhere.

These options come from Section 19 of the Hindu Marriage Act. If parallel cases are filed in Haryana and Delhi, only the Supreme Court can transfer a case from one state to the other, under Section 25 of the Code of Civil Procedure.

Marriage registration in Haryana

Marriages solemnised in Haryana must be registered under the Haryana Compulsory Registration of Marriages Act, 2008. A certified copy of the registration is useful proof of marriage. If the marriage was registered in Delhi or another state, that certificate is equally valid.

Counselling, complaints and protection in Faridabad

Faridabad is policed by the Faridabad Police Commissionerate, which has women police stations and women’s help desks that receive matrimonial complaints. Such complaints are often first taken up for counselling between the parties. Under the Protection of Women from Domestic Violence Act, 2005, the Protection Officer for the district can help an aggrieved woman prepare a domestic incident report and approach the magistrate for protection, residence or monetary relief.

  • Ancestral and joint property. Claims over property held by the husband’s family raise separate questions from maintenance. A wife’s right of residence under the Domestic Violence Act is different from a claim of ownership.
  • Commuting children. Where children study in Delhi schools but live in Faridabad, or the reverse, travel time and school routine are relevant to custody and visitation arrangements.
  • Hearing dates. Both spouses are generally required to be present for the statements in a mutual consent divorce. Planning dates around work and school avoids adjournments.

Only if a Delhi court has jurisdiction under Section 19 of the Hindu Marriage Act, for example because the marriage was solemnised in Delhi, the respondent lives in Delhi, or the couple last lived together in Delhi. Living in Faridabad and working in Delhi is not, by itself, enough.
