The family courts in Ghaziabad
Divorce, maintenance, custody and guardianship cases for Ghaziabad district are heard by the Family Courts at the Ghaziabad district court complex. The district covers the city areas, including Indirapuram, Vaishali, Vasundhara, Kaushambi, Raj Nagar, Raj Nagar Extension and Crossings Republik, as well as Loni, Modinagar and Muradnagar.
Appeals from the Ghaziabad Family Courts go to the Allahabad High Court. The same High Court would hear any petition to quash a related criminal case after settlement. For families who assume that “Delhi NCR” means the Delhi High Court, this is an important difference.
Ghaziabad or East Delhi: the border question
Trans-Hindon Ghaziabad (Indirapuram, Vaishali, Kaushambi and nearby areas) is minutes from East Delhi, and it is common for a couple to have married in Delhi, lived together in Ghaziabad, and then separated with one spouse moving back to a parent’s home in Delhi. Under Section 19 of the Hindu Marriage Act, a petition may be filed where:
- the marriage was solemnised;
- the respondent lives;
- the couple last lived together; or
- the wife lives, if she is filing.
In such cases the choice is often between Ghaziabad and the Family Courts at Karkardooma, which hear cases from East, North-East and Shahdara Delhi. The courts are in different states, with different High Courts above them. If each spouse files in a different state, bringing the cases together requires a transfer petition in the Supreme Court under Section 25 of the Code of Civil Procedure. Wives who find it difficult to travel to the other state often seek such a transfer, and the Supreme Court frequently considers the convenience of the wife in deciding these petitions.
Counselling, complaints and protection
Ghaziabad is policed by the Ghaziabad Police Commissionerate. In Uttar Pradesh, matrimonial complaints are commonly referred first to police family counselling centres, often known as Parivar Paramarsh Kendra, where both families are called for discussion before further action. Women’s help desks at police stations also receive complaints. Applications under the Protection of Women from Domestic Violence Act, 2005 can be made through the district’s Protection Officer or directly to the magistrate.
Joint families and property questions
Many Ghaziabad households are joint families, and the matrimonial home is often owned by the husband’s parents. Two issues come up frequently:
- Residence rights. Under the Domestic Violence Act, a woman may have a right to reside in the “shared household”, which the Supreme Court in Satish Chander Ahuja v. Sneha Ahuja (2020) held can include a house belonging to the husband’s relatives. This right is subject to the court’s orders and the facts of the case.
- Stridhan. Jewellery and gifts given to the wife are her property, even if kept in the family locker. Lists and photographs of stridhan items, and records of where they are kept, are useful.

Mediation and legal aid
The Ghaziabad Family Courts refer suitable cases to the mediation centre at the district court. The District Legal Services Authority, Ghaziabad provides free legal services to eligible persons, including women and children. Many couples resolve their disputes through mediation and then file for a mutual consent divorce.
Practical notes for Ghaziabad residents
- UP marriage registration. Marriages registered in Uttar Pradesh under the Uttar Pradesh Marriage Registration Rules, 2017 have an online registration certificate that serves as proof of marriage.
- Multiple cases. It is not unusual for a divorce case in one court, a maintenance case in another and a domestic violence case in a third to run side by side. Keeping all orders together, and disclosing them to each court, avoids problems.
- Children’s schooling. Where children attend school in Ghaziabad or East Delhi, courts are mindful of travel and continuity when deciding custody and visitation.
