The Family Court for Noida: Surajpur, Greater Noida
Gautam Buddh Nagar district’s courts, including its Family Courts, are located at the district court complex in Surajpur, Greater Noida. Divorce petitions, maintenance applications, custody and guardianship petitions for Noida, Greater Noida, Greater Noida West and the rest of the district are generally filed there. Because the complex is some distance from many Noida sectors, it helps to plan for travel time on hearing dates, particularly on days when both spouses must appear in person.
Appeals from the Family Court lie to the Allahabad High Court. This is different from Delhi, where appeals go to the Delhi High Court, and it affects where later proceedings, such as petitions to quash a related criminal case after settlement, will be heard.
Delhi or Noida? Choosing the right forum
A large number of couples living in Noida married in Delhi, or lived in Delhi before moving across the border. Under Section 19 of the Hindu Marriage Act, a petition can be filed where:
- the marriage was solemnised;
- the respondent lives at the time of filing;
- the couple last lived together; or
- the wife lives, if she is the one filing.
So a couple who married in East Delhi and last lived together in a Noida sector may be able to file either before the Family Court at Karkardooma in Delhi or at Surajpur. The two courts belong to different states. If one spouse files in Delhi and the other in Noida, the only court that can transfer a case from one state to the other is the Supreme Court, under Section 25 of the Code of Civil Procedure. Getting the forum right at the outset can avoid this.
Police counselling and complaints in Gautam Buddh Nagar
Noida and Greater Noida are policed by the Gautam Buddh Nagar Police Commissionerate. Matrimonial complaints are often routed first to the police family counselling arrangements (commonly called Parivar Paramarsh Kendra in Uttar Pradesh) or to women’s help desks, where both sides may be called for counselling before a decision is taken on registering a case. Complaints under the Protection of Women from Domestic Violence Act, 2005 can be made to the district’s Protection Officer or directly to the magistrate.
Marriage registration in Uttar Pradesh
Marriages in Uttar Pradesh can be registered under the Uttar Pradesh Marriage Registration Rules, 2017, through the state’s online registration system. A registration certificate is convenient proof of marriage in a divorce case. If your marriage was registered in Delhi instead, that certificate is equally valid; the certificate itself does not decide which court has jurisdiction.
Mediation and legal aid in Noida
The Family Court at Surajpur refers suitable matters to the mediation centre at the district court, and the District Legal Services Authority, Gautam Buddh Nagar, provides free legal services to eligible persons, including women and children. Many couples who start with a contested petition settle through mediation and move to a mutual consent divorce.
Practical notes for Noida residents
- Rented and society homes. Many Noida couples live in rented flats or apartments in group housing societies. Questions about the right to reside in the “shared household” under the Domestic Violence Act, and about who pays rent and maintenance charges, often arise early and may need interim orders.
- Corporate employment. Noida’s IT and corporate workforce means salary slips, Form 16, bonuses and stock-linked benefits are often relevant to maintenance and alimony calculations.
- Schools and custody. Where children attend school in Noida, courts are generally reluctant to disturb their schooling mid-year when deciding interim custody.

Divorce routes for Noida couples
The same central laws apply in Uttar Pradesh as in Delhi: a mutual consent divorce under Section 13B of the Hindu Marriage Act, a contested divorce under Section 13, or a divorce under the Special Marriage Act. What differs is the court, the High Court above it, and local practice.
