Family courts in Gurugram
Matrimonial cases for Gurugram district, which covers the city as well as areas such as Sohna, Pataudi, Manesar and Farrukhnagar, are heard by the Family Courts at the Gurugram district court complex. These courts deal with divorce under the Hindu Marriage Act and the Special Marriage Act, maintenance, custody and guardianship petitions.
Appeals from the Family Courts lie to the Punjab and Haryana High Court at Chandigarh. The High Court is also where any petition to quash a related criminal case on the basis of a settlement would be filed, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. For couples who live and work in Gurugram but come from Delhi, this is an important practical difference: later stages of the case may involve travel to Chandigarh or appearance by video.
Gurugram or Delhi: which court?
Many Gurugram residents married in Delhi or lived in Delhi before moving. Under Section 19 of the Hindu Marriage Act, a petition can be filed where the marriage was solemnised, where the respondent lives, where the couple last lived together, or where the wife lives if she is the petitioner. It is common for more than one of these to point to different states. Where parallel cases end up in Delhi and Haryana, only the Supreme Court can transfer a case between the two states, under Section 25 of the Code of Civil Procedure. Choosing the forum carefully at the beginning helps avoid this.
Marriage registration in Haryana
Haryana requires marriages solemnised in the state to be registered under the Haryana Compulsory Registration of Marriages Act, 2008. Couples who married in Gurugram will usually have a registration certificate, which is useful proof of marriage in court. Couples who married in Delhi or elsewhere may have a certificate from that state instead, which is equally acceptable.
Issues that often arise in Gurugram cases
Complex salary structures
Many Gurugram professionals receive a mix of fixed salary, variable pay, bonuses, stock options or restricted stock units, and other benefits. In maintenance and alimony proceedings, courts look at real income, not just the fixed component, and the affidavit of assets and liabilities required under Rajnesh v. Neha (2020) must disclose these benefits. Tax returns, Form 16, employer letters and brokerage statements are often relevant.
Both spouses earning
Where both spouses earn well, maintenance disputes often turn on the difference in income and on the needs of the children, rather than on one spouse having no income at all. Courts compare the standard of living during the marriage with each spouse’s present means.
Residence in the shared household
Gurugram couples frequently live in rented apartments, or in homes owned by one spouse’s parents. The Supreme Court in Satish Chander Ahuja v. Sneha Ahuja (2020) held that a “shared household” under the Domestic Violence Act can include a house belonging to the husband’s relatives where the wife lived in a domestic relationship. Questions about who may continue to live in the home often need early interim orders.
Relocation and international moves
Gurugram’s globally mobile workforce means that one spouse may relocate abroad during or after the separation. This affects service of summons, appearance, and especially child custody and travel with children. Our page on NRI divorce explains the issues.
Mediation, counselling and legal aid
The Gurugram courts have a mediation and conciliation centre, and Family Courts commonly refer matrimonial disputes to it. The District Legal Services Authority, Gurugram provides free legal services to eligible persons, including women and children. On the police side, Gurugram has women police stations, and matrimonial complaints are often first referred for counselling. Under the Domestic Violence Act, Protection Officers appointed by the Haryana government in each district can help an aggrieved woman file a domestic incident report.
Divorce routes for Gurugram couples
- Mutual consent divorce under Section 13B of the Hindu Marriage Act, often the most practical route where both spouses agree on terms.
- Contested divorce on grounds such as cruelty, desertion or adultery.
- Special Marriage Act divorce, common among interfaith and inter-community couples in Gurugram.
